How to apply Romania's 200 / 600 RON crypto exemption to your tax report

How to calculate and apply Romania's small gains exemption (200 / 600 RON) when filing your annual crypto tax report with ANAF.

If your tax residence is Romania, a portion of your annual crypto gains may be exempt from income tax. This article explains the rule and shows you how to apply it to the Capital Gains Report exported from Summ.

Overview

Romanian tax law (Article 116 of Law 227/2015) allows an exemption on small crypto gains in a calendar year, subject to two cumulative conditions:

  • Per-disposal test. Each individual disposal must produce a gain of less than 200 RON.

  • Annual cap. The total of those qualifying gains across the whole year must not exceed 600 RON.

If both conditions are met, the qualifying gains are exempt from income tax. If the annual total exceeds 600 RON, the exemption is lost for the entire year โ€” all gains become taxable. It's all or nothing.

๐Ÿ“” Note: Gains realised on or before 31 December 2025 are taxed at 10%. Gains from 1 January 2026 onwards are taxed at 16% (Law 239/2025). The exemption rule itself is unchanged.


Step by step

1. Download the Capital Gains Report.
After reconciling all your data and you are ready to report, head to the Reports page. Ensure the desired tax year is selected from the year selector on the top of the page and Download a Capital Gains Report. Make sure to acquire the CSV option and not the PDF.

2. Find your qualifying disposals.
Open the CSV in Excel, Google Sheets, or any spreadsheet tool, then:

  • Filter rows where the Gain column is greater than 0 and less than 200 RON.

  • Sum the Gain column for those filtered rows. Call this EXEMPT_TOTAL.

3. Apply the annual cap.

Exemption applies. Subtract EXEMPT_TOTAL from the year's total taxable gain when filing Form 212 (Declaraศ›ia Unicฤƒ) with ANAF via Spaศ›iul Privat Virtual.

Exemption is lost. Report the year's total taxable gain exactly as the app calculates it, with no adjustment.

๐Ÿ“” Note: Rows 1 and 3 have gains of exactly 200 RON and are not included in EXEMPT_TOTAL. The threshold is strictly less than 200 RON.

EXEMPT_TOTAL = 150 + 150 + 180 + 150 + 150 = 780 RON

780 RON exceeds the 600 RON cap, so the exemption is lost for the entire year.

  • Amount to file with ANAF: 7,180 RON, with no adjustment.

๐Ÿ“” Note: Once EXEMPT_TOTAL crosses 600 RON, you cannot exempt the first 600 RON and tax only the excess. Every small gain that would have qualified becomes taxable too.


Things to watch for

  • A 200 RON gain is taxable. The threshold is strictly less than 200 RON. A disposal with a gain of exactly 200 RON is included in your taxable total.

  • Each disposal is evaluated individually. Do not aggregate by day, by asset, or by exchange before applying the 200 RON test.

  • Crypto income is separate. Mining rewards, staking rewards, airdrops, and similar income events are taxed under different rules and are not part of the 600 RON cap. Do not include them in EXEMPT_TOTAL.
